OBJECT

The present general terms and conditions of sale (hereinafter referred to as "Terms and Conditions") govern the contractual relationship and transactions between the Company REIS PARIS, SAS with a capital of 1000 euros, registered in the Nanterre Trade and Companies Register under number 849 573 019, whose registered office is located at 128, rue la Boétie 75008 PARIS, operating under the trade name REIS PARIS (hereinafter referred to as the "Seller"), and any individual consumer (hereinafter referred to as the "Customer") placing an order for pants and other garments (hereinafter referred to as the "Products") via the online store on the website www. leboubou.com (hereinafter Site), online shopping site accessible to any user of the Internet.

The Terms and Conditions prevail over all other conditions appearing in any other document. Any order by the Customer implies the full and unreserved acceptance of the Customer to the Terms and Conditions, the Customer acknowledging that he/she has a perfect knowledge of them.

The Terms and Conditions are subject to change at any time, those applicable are those in force on the day the order is placed by the Customer.

The Terms and Conditions are available for consultation in English.

PRODUCTS

The Products offered for sale on the Site are intended for personal and private use by the Customer.

The Site presents, for each product, a description giving the Customer the required information on the essential characteristics of the Product and on its price.

The photos and visuals of the Products are provided for illustrative purposes and are not contractual.

The Products are in conformity with the prescriptions of the French law in force at the date of their setting on sale, relating to the safety and health of the people, the loyalty of the commercial transactions and the protection of these consumers.

PRICES

The applicable sales prices are the prices in effect at the time the order is placed, as displayed on the Site, all taxes included if you put an european facturation address.

To the selling price of the Product ordered, delivery costs must be added, if applicable.

The total amount due by the Customer is indicated at the time of the order confirmation.

The Vendor reserves the right to modify its prices at any time, while guaranteeing the Customer the application of the price in force at the time of the order.

AVAILABILITY OF PRODUCTS

The Products offered for sale on the Site are available.

In the event that a Product is unavailable, the words "Out of stock" will appear on the description of the Product.

LEGAL GUARANTEES

All Products benefit from the legal guarantee of defects of the thing sold, provided by articles 1641 and following of the Civil Code and the guarantee of conformity, provided by articles L.211-4 and following of the Consumer Code.

When the Customer acts in legal guarantee of conformity:

He has a period of two (2) years from the delivery of the Product to act.

He is free to choose between the replacement of the non-conforming Product or its reimbursement subject to certain cost conditions provided for in Article L.211-9 of the Consumer Code.

The Customer is exempted from proving the lack of conformity of the Product for a period of one (1) month following the delivery of the said Product.

The Customer is also entitled to implement the warranty for hidden defects of the product as defined in Article 1641 of the Civil Code.

In case of implementation of such a guarantee, the Customer is free to choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

ORDER

The Customer declares to be at least 18 years old and to have the legal capacity or to be the holder of a parental authorization allowing him to place an order on the Site.

The order of a Product is made with obligation of immediate payment.

To place an order for a Product on the Site, the Customer must follow the following process and steps:

• click on the Men or Women tab

• choose the Product(s) from the catalog.

• click on the chosen Product.

• on the screen, appear the picture of the Product, the essential characteristics of the Product, its price and its delivery time, and the tab Information before ordering.

• select the size.

• add to cart.

• click on my cart to see the summary of the order.

• modify or not the order.

• accept the terms and conditions.

• validate the order.

• pay

At the end of the ordering process, the Customer receives by e-mail the confirmation of the registration of his order and the purchase invoice.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there are difficulties related to previous orders.

The Seller will notify the Customer by e-mail when the order is sent.

PAYMENT

The amount due by the customer is payable in full when ordering the Product.

The Customer has two means of payment:

Payment by credit/debit card
Payment via Paypal
The Seller reserves the right to suspend or cancel any order in case of difficulties encountered in the collection of payment.

DELIVERY

The delivery of the Product is made by mail after placing the order and payment of the price by the Customer.

The delivery is made to the geographical address communicated by the Customer at the time of the order.

If the delivery is made impossible because of inaccurate or incomplete information from the Customer, the Seller will notify the Customer by e-mail, and in case of no response, will cancel the order and refund the sums paid by the Customer.

The delivery time is :

between 1 and 4 days for France.
between 3 and 7 days for European countries.
between 5 to 14 days in non-European country.
Delivery is free of charge for all orders over 440€ in Europe.

For an order of less than 440€, delivery costs are at the Customer's expense, according to the postal rates in force, depending on the destination.

A delay in delivery of more than seven days, not due to a case of force majeure, may result in the termination of the sale if the Customer so requests by registered letter with acknowledgment of receipt addressed to the Seller's head office.

Total failure to deliver due to the Seller, not due to a case of force majeure, shall result in the automatic cancellation of the sale.

Total failure to deliver on the part of the Seller, not due to force majeure, shall result in the automatic termination of the sale.

For NON-EU Customer, you will encounter import taxes and fee to pay at your courrier upon receiving your order. Amount of these taxes and import fees depends on the country.

Le Boubou is not responsible for any problems encountered during importation if the customer does not respond to various reminders from customs, the carrier or Le Boubou. 

RIGHT OF WITHDRAWAL

In accordance with the provisions of Articles L 121-21 and following of the Consumer Code, the Customer has a withdrawal period of fourteen days (14 days) from receipt of the Product purchased.

To exercise the right of withdrawal, the Customer must notify the Seller of

his name, geographical address, telephone number and e-mail address.
his decision to exercise his right of withdrawal by mail or e-mail.
In case of withdrawal, the Customer must return the Product to the Seller, in its original packaging, with the labels, in perfect condition, unworn, without dirt or deterioration.

The Customer must send the Product back after getting a validation of return from Le Boubou by contacting us at contact@leboubou.com and send the items to the following address :

without undue delay and no later than fourteen days after his decision to withdraw.

The costs of returning the product are at the Customer's expense.

The Seller will refund all payments received, excluding delivery charges, without undue delay and no later than fourteen days after the return of the product in perfect condition.

The Seller will use the same method of reimbursement as the one used by the Customer for the payment of his order.


AFTER-SALES SERVICE - COMPLAINTS

RESPONSIBILITY

The responsibility of the Salesman cannot be engaged in the event of non-performance or bad execution of the sale due either to the fact of the Customer, or to the insurmountable and unforeseeable fact of a third party to the contract, or to the force majeure.

The responsibility of the Seller cannot be engaged in case of malfunctions or damages related to the use of the Internet network, such as break in service, external intrusion, presence of computer viruses, fraudulent use of the credit card, etc...


INTELLECTUAL PROPERTY

The Products offered for sale on the Site are protected by the law of drawings and models and the law of trademarks.

Any reproduction, total or partial, distribution, use for commercial purposes of the Products, is strictly forbidden.


PERSONAL DATA

The Seller undertakes not to communicate to third parties the personal data provided by the Customer, unless it is obliged to do so by legal provisions or by court order.

In accordance with the law n° 78-17 of January 6, 1978 relating to data processing, the files and freedoms, the Customer can obtain communication and, if necessary, modification, correction or suppression of information relating to it.

APPLICABLE LAW

The Terms and Conditions and the contractual relations between the Seller and the Customer are subject to French law.
